Rental Agreement

This Rental Agreement is between Affordable Rentals Tampa Bay, LLC (“ARTB,” “we,” “us”) and the customer named below (“you”). By signing this agreement, you acknowledge that you have read, understand, and agree to the Terms & Conditions listed below, which govern the rental of the items, dates, and amounts shown in this agreement.

1. Client Information

Client must provide accurate information including name, address, phone number, email, emergency contact, event location, and event date(s).

2. Rental Dates

The rental period begins on the agreed start date and ends on the agreed end date as documented on the invoice or rental agreement.

3. Order Summary

All rented equipment and services will appear automatically based on the attached invoice, and the client is responsible for reviewing all quantities, pricing, and item descriptions.

4. Pricing, Fees, and Payment

All pricing is in U.S. dollars. Charges may include rental fees, delivery convenience fees based on distance, and applicable sales tax. Payment is required before any equipment is released. A card may be kept on file and charged for damage, loss, or unreturned items; however, no upfront hold is placed. Payments are processed securely through Square, and ARTB does not store full card numbers.

5. Booking Status

Submitting a booking constitutes a request only. A rental is confirmed once ARTB accepts the booking and payment is processed. ARTB may decline or cancel if equipment is unavailable, the delivery location is outside the service area, or information cannot be verified. The signed rental agreement provided at delivery governs the rental.

6. Delivery, Setup, and Pickup

ARTB delivers, sets up, and picks up equipment within a 40-mile radius of ZIP code 33613. The client must provide clear, safe access to the setup area, and an adult at least 18 years of age must be present at delivery and pickup. Customer pickup may be available for locations outside the service area.

7. Equipment Condition and Proper Use

All equipment is provided in good working condition. The client agrees to use all equipment only as intended, follow instructions provided by ARTB, keep items clean and secure, and refrain from moving, modifying, subleasing, or attaching anything to the equipment that may cause damage.

8. Assumption of Risk (Florida)

The client acknowledges that event equipment involves inherent risks, including slips, falls, electrical hazards, heat exposure, allergens, and weather‑related risks. By renting and using the equipment, the client voluntarily assumes all such risks.

9. Liability Waiver

To the fullest extent permitted by Florida law, the client releases ARTB from liability for injuries, damages, or losses resulting from ordinary negligence during the rental period. ARTB’s total liability, if any, will not exceed the amount paid for the rental.

10. Damage, Loss, or Theft

The client is responsible for any loss, theft, disappearance, or damage to the equipment beyond normal wear. Full replacement cost will be charged for items that are lost, stolen, or destroyed.

11. Weather Policy (Rain or Shine, No Refunds)

All rentals operate on a rain‑or‑shine basis, and no refunds, credits, or reductions will be issued due to weather or unexpected events. This includes rain, wind, heat, cold, storms, lightning, flooding, or any other naturally occurring conditions. If severe weather makes use of the equipment unsafe, the client must stop using the equipment immediately. The client remains responsible for protecting and safeguarding the equipment during all weather conditions.

12. Nature‑Related Causes (Force Majeure)

Neither ARTB nor the client will be held responsible or liable for delays, cancellations, damages, or failures caused by natural events outside human control, including storms, hurricanes, lightning, flooding, high winds, or any other acts of nature or force majeure events. These events do not relieve the client of payment obligations or the responsibility to protect the rented equipment.

13. Safety and Supervision

The client is responsible for supervising all equipment at all times and ensuring safe and proper use according to ARTB’s instructions.

14. Equipment Return

Equipment must be returned to the agreed‑upon location and in the same condition in which it was received. Additional charges apply for late, incomplete, or improper returns.

15. Cancellations and Refunds

Cancellations are subject to our posted cancellation policy, which may include partial or no refund depending on how far in advance you cancel. Any non‑refundable reservation fee is applied toward your balance.

16. Website Content Ownership

All content on ARTB’s website, including text, images, branding, and logos, is the property of ARTB or its licensors and may not be copied or reused without written permission.

17. Changes to Terms

ARTB may update these Terms & Conditions at any time. The version posted at the time of booking applies to that booking.

18. Governing Law

These Terms are governed by the laws of the State of Florida. If any provision is found unenforceable, the remaining provisions remain in effect.

19. Electronic Signatures

Electronic signatures are valid and enforceable under Florida law and carry the same legal effect as handwritten signatures.
